📄 TERMS OF SALE – THE NYX ROOM
1. Identification

2. Purpose
These Terms of Sale define the conditions for creating, launching, and maintaining a website under the “Essential Site” offer.
3. Service description
The service includes:
• Creation of a 1-page website (landing page)
• Responsive design (mobile and desktop)
• Contact form
• WhatsApp / Instagram integration
• Website launch
The launch timeframe is estimated between 24 and 48 hours after full receipt of all required materials provided by the client.
The project starts only after receiving all content.
4. Pricing and payment
Prices are in euros, including or excluding taxes depending on your status.
The client agrees to pay:
• €200 for website creation (initial payment)
• Then €19/month from day 30 (monthly subscription)
Payment is made via the secure Stripe platform.
The initial payment is non-refundable once the service has started.
5. Right of withdrawal
In accordance with applicable law, the client has a 14-day withdrawal right.
However, by proceeding with payment and requesting immediate service execution, the client expressly waives this right.
6. Monthly subscription
The subscription includes:
• Website hosting
• Technical maintenance
• Security and updates
• Customer support (email or WhatsApp, reply within 24–48h)
• Up to 5 minor change requests per month
Minor changes include:
• text edits
• image replacements
• simple adjustments without structural changes
More complex requests will be quoted separately.
7. Nature of the service
The website is provided as part of a service with an active subscription.
The client does not own the technical infrastructure but has usage rights.
8. Access and management
Hosting and technical management are handled by The Nyx Room.
The client does not have full access to the site’s technical structure.
9. Domain name
The domain name is:
• purchased by the client
• the exclusive property of the client
The Nyx Room acts only as a technical provider.
10. Termination
The client may cancel the subscription at any time.
Termination takes effect at the end of the current monthly period.
Termination results in the website being taken offline.
Transfer to another hosting provider is possible upon request and is a paid service (from €100).
11. Suspension
In case of non-payment:
• the website may be suspended immediately
• certain features may be disabled
After 30 days, the website may be permanently deleted without obligation to retain it.
12. Liability
The Nyx Room does not guarantee:
• commercial results
• SEO ranking
• traffic levels
The Nyx Room cannot be held responsible for:
• third-party services (WhatsApp, Instagram, etc.)
• technical interruptions
• indirect losses
Liability is limited to the amount paid by the client.
13. Personal data
The client is responsible for:
• website content
• legal notices
• privacy policy
The Nyx Room acts as a technical provider and does not use collected data.
14. Force majeure
The Nyx Room cannot be held responsible for events beyond its control preventing service execution.
15. Disputes
In case of dispute, an amicable solution will be sought first.
Failing that, French courts shall have jurisdiction.
16. Acceptance
By making payment, the client acknowledges having read and accepted these Terms of Sale.
