📄 TERMS OF SALE – THE NYX ROOM

2. Purpose
These Terms of Sale define the conditions for the creation, launch, and maintenance of a website under the Premium Site offer.
3. Service description
The service includes:
• Creation of a website up to 10 pages
• Premium custom design
• Advanced conversion-oriented structure
• Optimized user experience (UX)
• Advanced contact forms
• Social media integration (WhatsApp, Instagram, etc.)
• Image and video integration
• Online store up to 20 products
• Secure payment system integration
Multilingual version (2 languages) included upon request.
The launch timeframe is estimated between 5 and 10 days after full receipt of all materials provided by the client.
The project starts only after receiving all required content.
4. Pricing and payment
Prices are in euros, including or excluding taxes depending on your status.
The client agrees to pay:
• €800 for website creation (initial payment)
• Then €69/month from day 30 (monthly subscription)
Payment is made via the secure Stripe platform.
The initial payment is non-refundable once the service has started.
5. Right of withdrawal
In accordance with applicable law, the client has a 14-day withdrawal right.
However, by proceeding with payment and requesting immediate execution of the service, the client expressly waives this right.
6. Monthly subscription
The subscription includes:
• Website hosting
• Technical maintenance
• Security and updates
• Priority customer support (email or WhatsApp, reply within 24h)
• Up to 20 minor change requests per month
• Continuous website optimization
Minor changes include:
• text edits
• image replacements
• simple adjustments without structural changes
More complex requests (adding pages, new features, custom development) will be quoted separately.
7. Nature of the service
The website is provided as part of a service with an active subscription.
The client does not own the technical infrastructure but has the right to use the website.
8. Access and management
Hosting, technical management, and infrastructure are handled by The Nyx Room.
The client does not have full access to the technical structure of the website.
9. Domain name
The domain name is:
• purchased by the client
• the exclusive property of the client
The Nyx Room acts only as a technical provider.
10. Termination
The client may cancel the subscription at any time.
Termination takes effect at the end of the current monthly period.
Termination results in the website being taken offline.
Transfer of the website to another hosting provider is possible upon request.
This service is billed from €200, depending on project complexity.
11. Suspension and deletion
In case of non-payment:
• the website may be suspended immediately
• certain features may be disabled
After 30 days of non-payment, the website may be permanently deleted without obligation to retain data.
12. Liability
The Nyx Room does not guarantee:
• commercial results
• SEO ranking
• traffic levels
The Nyx Room cannot be held responsible for:
• third-party services (social media, payment tools, etc.)
• technical interruptions
• indirect losses
Liability is limited to the amount paid by the client.
13. Personal data (GDPR)
The client is responsible for:
• website content
• legal notices
• privacy policy
The Nyx Room acts as a technical provider and does not use data collected via the client’s website.
14. Force majeure
The Nyx Room cannot be held responsible for events beyond its control preventing service execution.
15. Disputes
In case of dispute, an amicable solution will be sought first.
Failing that, French courts shall have exclusive jurisdiction.
16. Acceptance
By making payment, the client acknowledges having read and accepted these Terms of Sale.
